Promotion Terms and Conditions

In the following terms & conditions “the photographer” shall mean Lightsmith. “The Client(s)” shall be those persons defined as per invoice. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing. 

 

Promotion: The promotion will run from 22/11/2021. Promotional prices are inclusive of 7% GST charges.

 

Photographs and Images: Images will be delivered via online secure mediums. Original digital images are kept on an active file for one month. Photographer has no obligation to retain or archive any of the Images thereafter. Images can be presented in a CD upon request, subjected to additional charges. Raw images not included.

 

Copyright: The entire copyright in the photograph/images is retained by the Photographer, Lightsmith, at all times. All published usages of Images will be accompanied by written credit to Photographer. Client(s) may not assign or transfer this agreement or any rights granted under it.

 

Display: The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.

 

Deposit: A non-refundable 50% deposit will be charged when the client has confirmed a booking for a specific time and date. This fee is deducted (in full) from the total price. The booking fee secures the time and services of the photographer and is non-refundable or transferable in the event of cancellation. Once the deposit is made, Lightsmith will not accept any other work from other clients for those times and dates.

 

Payment: Full payment is to be made within 14 days after the shoot.

 

Cancellations: Unless otherwise agreed in writing, Client(s) will be responsible for payment of all expenses incurred up to the time of cancellation of the assignment. If notice of cancellation is given less than two (2) business days before the shoot date, Client(s) will be charged full price of the shoot. All cancellations must be in writing.

 

Entry into the promotion: The organiser may without prior notice, at any time and in its sole discretion, cancel, terminate, modify or suspend the promotion without being liable in any way to anyone. Entry into this promotion is deemed acceptance of the above T&Cs and any amendments, additions, replacements, variations and modifications hereto.

 

Lightsmith reserves the right, at its sole discretion to amend, withdraw or revise these terms and conditions at any time without prior notice and in such event, Lightsmith shall not have any liability whatsoever.
